Speculation and debate surrounding the incident continue to this day.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Facts of the Case<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>On 3 August 2018, at around 8:00 PM, nine young people, including LGBT activists staying in Shurnukh, were attacked by more than 20 residents of the village and the nearby city of Goris. The attackers verbally abused and insulted the victims because of their sexual orientation and gender identity. They also physically assaulted them by punching and kicking them, throwing stones at them, chasing them, and intimidating them while continuing to attack them with stones during the pursuit.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In August 2018, a criminal case was initiated by the Goris Division of the Syunik Regional Police Department under Article 118 of the Criminal Code of Armenia (battery\/beating).<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>All nine victims were officially recognized as injured parties in the criminal proceedings.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>During the preliminary investigation, both the victims and the perpetrators repeatedly stated that the attack was motivated by hatred toward the victims\u2019 sexual orientation and gender identity and expression. The perpetrators also confirmed this in interviews with various media outlets afterward. Despite this, the investigative authorities ignored the discriminatory motive and failed to examine the crime as hate-motivated. No individual was charged in the case.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In November 2018, the investigator handling the case decided to terminate the criminal proceedings and not pursue criminal prosecution against four perpetrators based on an amnesty act.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Through separate decisions, criminal prosecution against the remaining perpetrators was also dismissed on the grounds that their actions allegedly did not constitute a criminal offense, as they had delivered \u201conly one blow,\u201d which, according to the Criminal Code, was not considered battery.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>These decisions were appealed before supervising prosecutors and later before the courts.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Throughout 2019 and 2020, Armenian courts issued three separate decisions acknowledging that the investigative authorities had failed to conduct a full, comprehensive, and objective investigation. The courts noted several shortcomings, including the failure to consider the psychological suffering inflicted on the victims, the discriminatory motive based on sexual orientation and gender identity, and the issue of compensation for damages suffered by the victims.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>As a result of these judicial decisions, the investigation was reopened.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>However, after reopening the case, the investigative authorities again failed to properly address the discriminatory motive behind the crime. No one was recognized as an accused person. The case was not investigated under Article 143 of the Criminal Code (violation of equality rights) or Article 119 (causing severe physical pain or severe mental suffering).<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In February 2021, the investigative body once again terminated the criminal case and decided not to pursue criminal prosecution, this time on the grounds that the statute of limitations for criminal liability had expired.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In 2022, the court issued a decision granting the complaint of the injured party. The court found that the investigating authority had conducted an incomplete investigation. This decision was appealed by the prosecutor\u2019s office, but the Criminal Court of Appeal of the Republic of Armenia rejected the appeal.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In 2023, the decision to terminate the criminal proceedings and not to initiate criminal prosecution was annulled by the Prosecutor of Syunik Province. The decision was sent to the Syunik Regional Investigative Department of the Investigative Committee of Armenia with instructions to continue the preliminary investigation and remedy violations of the victims\u2019 rights.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In 2025, a decision was again issued not to initiate public criminal prosecution against the suspected individuals. The decision was appealed to the higher prosecutor but was rejected on the grounds that the incident arose from mutual insults and the victims\u2019 \u201cimmoral and antisocial behavior,\u201d rather than their sexual orientation or gender identity, and that the violence did not have a discriminatory intent or the intention to cause mental suffering; therefore, the elements of both discrimination motivated by hatred and the relevant criminal offences were absent.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Court of First Instance of Syunik Province granted the complaint submitted by the victims\u2019 representatives, annulling the prosecutor\u2019s decision not to initiate criminal proceedings. At the same time, the court obliged the investigative body to ensure a proper, comprehensive, prompt, and non-delayed preliminary investigation. The court noted that the preliminary investigation had produced contradictory factual data, which were significant for establishing or refuting the facts to be proven in the proceedings as well as other circumstances relevant to the case. The court disagreed with the prosecutor\u2019s claim that the incident was not related to the victims\u2019 gender identity and therefore could not involve a violation of equality. The court also expressed disagreement with the legal qualification of the act, which ignored the interest in protecting the victims\u2019 constitutional rights related to equality. It also noted that the victims\u2019 sexual orientation, gender identity, and the circumstances preceding and accompanying the alleged incident had not been properly assessed, including discriminatory statements directed at them, which indicate that the act may have been committed with a hate motive.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Strategic Importance of the Case<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Republic of Armenia is obligated to ensure the enjoyment of human rights without discrimination based on any characteristic. The state must create an environment in which rights can be effectively exercised and establish legal mechanisms allowing victims of violations to restore their infringed rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although Armenian domestic legislation guarantees the right to non-discrimination, sexual orientation and gender identity are not explicitly included among the protected grounds. The Armenian Criminal Code establishes liability for violating a person\u2019s rights and freedoms on discriminatory grounds; however, sexual orientation and gender identity are likewise not expressly listed as protected characteristics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The list of protected grounds under Armenian law is open-ended, and the jurisprudence of international human rights treaty bodies recognizes sexual orientation and gender identity as protected characteristics equivalent to sex, race, and others. Nevertheless, the absence of explicit legal recognition of these grounds in Armenian legislation has resulted in the ineffective application of anti-discrimination protections in practice. This is evidenced by the fact that no case handled by Pink, nor any case within Armenian legal practice generally, has ever been qualified under Article 143 of the Criminal Code on the basis of discrimination related to sexual orientation or gender identity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wide public attention surrounding the Shurnukh case provides an important opportunity to highlight the legislative gaps in the protection of LGBT rights in Armenia. Through this case, the goal is to ensure the effective application of existing domestic legal mechanisms and, if that proves impossible, to advocate for legislative reforms \u2014 including explicitly recognizing sexual orientation and gender identity as protected grounds in Armenian laws and the Constitution, as well as adopting a separate anti-discrimination law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, the case aims to raise public awareness regarding LGBT people, discrimination against them, and violations of their rights, ultimately contributing to changing public attitudes toward LGBT individuals in Armenia.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In August 2018, violence against nine young people, including LGBT activists vacationing in the village of Shurnukh in Armenia\u2019s Syunik Province, caused major public outrage and has continued to attract widespread attention ever since.
